PROCESSING PURPOSES AND LEGAL BASIS

Your personal data are processed by the Controller for various purposes, to different extent and on different legal grounds provided for in the GDPR. Below you will find information concerning the processing of your personal data, grouped according to the purposes for which the data are processed by the Controller.

  1. The data processing is necessary for the performance of a contract to which you are a party or to take steps at your request prior to entering into a contract. Pakmar is processing contact information from customers, prospects, suppliers and other business partners for communication by e-mail, telephone, fax and mail. The legal basis for data processing is Art. 6 para. 1 f) GDPR. The legitimate interest on the part of Pakmar arises from the interest to conduct or initiate the business relationship with customers, interested parties, suppliers and other business partners and to maintain personal contact with contact persons.
  2. The data processing is necessary for compliance with a legal obligation to which we are subject (like invoicing, keeping the accounting records, complaint handling).
  3. The processing is necessary for legal interests being pursued by Pakmar or by third parties (unless the interests or fundamental rights and freedoms of the party requiring the protection of personal data prevail).
  4. The data processing is necessary for internal use of controller to create statistics, analyzes, budgeting and list of active and potential customers, sales reports.
  5. The data processing is necessary for checking the credibility and solvency of existing and potential customers.
  6. The data processing is necessary for direct marketing during the term of the contract

DATA RECIPIENTS

The recipients or categories of recipients of your personal information include you and processors:

  1. information technology (IT) service providers,
  2. marketing services providers to the Controller (including marketing agencies),
  3. debt collectors,
  4. legal entities providing legal services,
  5. loss adjusters of insurance companies,
  6. courier and post office services,

INFORMATION ABOUT THE INTENTION TO TRANSFER PERSONAL DATA TO A THIRD COUNTRY

Pakmar sp. z o. o. does not transfer personal data outside the European Economic Area (EEA).

INFORMATION ABOUT AUTOMATED DATA PROCESSING, INCLUDING PROFILING

While data processing Pakmar Sp. z o. o. is not using any profiling or any other automated data processing.

DATA STORAGE PERIOD

Your personal data is stored by the Controller for no longer than it will be necessary for the purposes for which the data will be processed.

RIGHTS OF DATA SUBJECTS

Please be advised that you have the right to access your personal data, rectify it, delete it or limit processing, as well as the right to withdraw your consent.

RIGHT TO OBJECT

Regardless of the rights listed above, you have the right to object to the processing of data for direct marketing purposes. Requests in this matter should be sent to the e-mail address abi@pakmar.com.pl. After accepting the request, we are obliged to stop processing data for this purpose. In specific situations, you may at any time object to the processing of your personal data by us, if the legal basis for the use of the data is the legitimate interest of the administrator or public interest. In such a situation, after considering your request, we will no longer be able to process your data covered by the objection on this basis, unless we demonstrate that there are: valid legitimate grounds for data processing, which by law are deemed to override your interests, rights and freedom or grounds for establishing, investigating or defending claims

INFORMATION ON VOLUNTARINESS OR OBLIGATION TO PROVIDE DATA

To the extent that the processing of your data takes place in order to perform the contract with Pakmar Sp. z o. o., providing your data is a condition for concluding this contract. Providing data is voluntary, but it is necessary for the conclusion and performance of the contract. If personal data is not provided, the contract will not be concluded. Providing the data necessary to issue an invoice is a statutory obligation. In the remaining scope, providing personal data is voluntary, it is not a statutory or contractual requirement and is not a condition for concluding a contract.
